These Terms and Conditions set out the rules for using the Kleine Atelier online shop and the terms governing the sale of products offered by MatAmsterdam, trading under the name Kleine Atelier.

2. Scope of application

These Terms and Conditions apply to all offers, orders, purchases, and agreements concluded through the Kleine Atelier online shop, unless expressly agreed otherwise in writing.

These Terms and Conditions apply to both private customers and business customers, unless stated otherwise in a specific provision.

3. Products and offer

Kleine Atelier offers, among other things:

  • original paintings,
  • artist prints and inkography,
  • print on canvas,
  • artistic souvenirs,
  • selected art products available in the online shop.

Each product is individually described on the website. Product photographs, descriptions, dimensions, and colours are presented as accurately as possible. However, slight differences in the appearance of colours or details may occur due to screen settings, lighting conditions, or the artistic nature of the work.

In the case of unique products, especially original paintings, availability is limited to one piece unless stated otherwise.

Products made on commission are not normally available for direct purchase through the online shop cart and are only offered on the basis of individual arrangements made by email or in another agreed manner.

4. Prices

All prices shown in the online shop are displayed in the currency indicated on the website and include VAT unless stated otherwise.

Shipping costs are not always included in the product price and are calculated automatically during checkout, depending on the delivery country, the type of product, and the selected shipping option.

Kleine Atelier reserves the right to change prices. However, the price applicable to the customer is the price displayed at the time the order is placed.

In the event of an obvious pricing, technical, or description error, Kleine Atelier reserves the right to cancel the order and refund any payment made.

5. Conclusion of the agreement

A sales agreement is concluded once Kleine Atelier confirms acceptance of the order.

Kleine Atelier reserves the right to refuse or cancel an order in justified cases, including in particular where:

  • the product has become unavailable,
  • a pricing or technical error has been identified,
  • a significant defect has been found in an original painting requiring its withdrawal from sale,
  • delivery to the selected country or region is not possible,
  • there is a justified suspicion of abuse or irregularity in the order,
  • circumstances beyond the control of Kleine Atelier make fulfilment impossible.

If an order is cancelled after payment has been made, the paid amount will be refunded as soon as reasonably possible.

6. Payments

Online payments in the shop are processed primarily through an external payment provider.

Available payment methods may include, among others:

  • iDEAL / Wero,
  • Pay with Klarna,
  • Pay later (Klarna),
  • In3,
  • PayPal,
  • Bancontact.

The currently available payment methods are displayed during checkout.

Payment on collection is available only for orders collected in person from the gallery. Kleine Atelier does not offer cash on delivery for shipped orders.

Payment by invoice is available only to registered and verified B2B customers. The payment term is agreed individually and is usually 7 days, unless agreed otherwise in writing.

Kleine Atelier reserves the right to refuse payment by invoice or to change the conditions for this payment method.

7. Retention of title

All products remain the property of MatAmsterdam / Kleine Atelier until full payment for the order has been received.

8. Delivery and collection

Kleine Atelier ships domestic and international orders, primarily through PostNL.

The estimated processing or delivery time is shown on each product page. For custom-made products, the timeframe is agreed individually.

All shipments are packed with great care. The packaging method is always adapted to the type of product in order to ensure the safest possible transport.

In the case of larger paintings that exceed the permitted dimensions for standard parcel delivery, the artwork may be shipped removed from the stretcher and without a frame, rolled in a protective tube. This is indicated on the product page and/or in the relevant delivery option.

Shipping costs are calculated automatically during checkout.

Orders collected in person are handed over only after the collection time has been agreed in advance.

If a parcel is returned to the sender for reasons attributable to the customer, such as an incorrect address, failure to collect the parcel, or lack of required action by the recipient, reshipping may require the customer to pay additional delivery costs.

9. Customs duties, import taxes, and international deliveries

For orders shipped outside the European Union, local customs rules, import taxes, or additional charges may apply depending on the destination country.

If such charges are not already included at checkout, they remain the responsibility of the buyer.

Kleine Atelier is not responsible for delays caused by customs procedures, local import restrictions, or carrier decisions.

10. Obligation to inspect the shipment

The customer should inspect the shipment at the time of delivery.

If the outer packaging shows visible signs of damage, this should be reported directly to the courier or carrier upon delivery, and Kleine Atelier should be informed without delay.

If damage is discovered only after unpacking, the customer should:

  • keep the outer and inner packaging,
  • take clear photographic documentation,
  • report the issue to Kleine Atelier without delay.

The documentation should, where possible, include:

  • the outer packaging,
  • the shipping label,
  • the inner packaging,
  • the product itself,
  • close-up details of the damage.

Prompt notification is important for the assessment of the damage and for any insurance or transport-related claim procedure.

11. Complaints and transport damage

In the event of a complaint or transport damage, Kleine Atelier will assess the claim on the basis of the information, photographs, and the nature of the product.

For original paintings, due to their unique nature, replacement is usually not possible. As a first step, Kleine Atelier may offer a professional repair of the artwork where this is reasonable and technically possible. In such a case, it may be necessary to return the properly protected painting to Kleine Atelier for repair and reshipment.

For prints, inkography, canvas prints, or artistic souvenirs, the resolution will depend on the type and extent of the damage. Where appropriate, this may include replacement, repair, a price reduction, or another suitable solution.

If the carrier requires a specific claim procedure, the customer is expected to cooperate where necessary for the proper handling of the claim.

12. Right of withdrawal for consumers

A customer acting as a consumer has the right to withdraw from an online purchase without giving any reason within 14 calendar days from the day of receiving the product.

To exercise the right of withdrawal, the customer must send Kleine Atelier a clear statement of withdrawal. The statement may be sent:

For verification purposes, the withdrawal notice should preferably be sent from the same email address that was used when placing the order as a guest or the same email address linked to the registered customer account. If this is not possible, the customer should provide sufficient information to allow the order to be identified.

After a valid withdrawal, the customer must return the product without undue delay in accordance with applicable law.

The direct cost of returning the product in the case of a standard withdrawal is borne by the customer, unless mandatory law provides otherwise.

The refund will be made after the returned product has been received or after proof of return has been provided, whichever occurs first, in accordance with applicable law.

13. Exceptions to the right of withdrawal

The right of withdrawal does not apply in cases provided for by applicable law, in particular in relation to:

  • products made to individual order,
  • personalised products,
  • products made according to the customer’s specifications,
  • B2B orders where the buyer acts as a business.

As products made to individual order are handled only through separate arrangements, the terms relating to production, payment, delivery, and any possible cancellation or withdrawal are agreed individually.

14. Conditions for returning a product

A returned product should be sent back in a condition suitable for inspection, with due respect for the nature of the product, preferably in the original packaging or in equally secure protective packaging.

The customer is liable for any reduction in the value of the product resulting from handling beyond what is necessary to establish the nature, characteristics, and functioning of the product.

If the returned product is damaged due to inadequate packaging during the return shipment, the customer may be held responsible for that damage.

16. B2B customers

The provisions regarding the right of withdrawal do not apply to customers purchasing as businesses, unless expressly agreed otherwise in writing.

Individual arrangements may be made for B2B customers regarding payment, invoicing, delivery, and cooperation terms.

In the case of payment by invoice, the B2B customer is obliged to pay within the agreed payment term.

17. Force majeure

Kleine Atelier shall not be liable for non-performance or delay in performance where this results from circumstances beyond its reasonable control, including in particular:

  • transport restrictions,
  • logistics or customs problems,
  • temporary or permanent inability to deliver to a specific country or region,
  • actions of public authorities,
  • system failures,
  • unforeseen events,
  • the discovery of a defect in an original painting requiring suspension of the sale,
  • other circumstances beyond the control of Kleine Atelier.

In such situations, Kleine Atelier has the right to suspend fulfilment, propose an alternative solution, or cancel the order with a refund of the amount paid.

18. Liability

Kleine Atelier exercises due care in presenting products, accepting orders, packaging, and fulfilling sales.

The liability of Kleine Atelier is limited to the extent permitted by applicable law.

Nothing in these Terms and Conditions excludes or limits any consumer rights granted by mandatory law.

19. Copyright

All copyrights in content, photographs, descriptions, designs, and images of artworks published by Kleine Atelier belong to MatAmsterdam / Kleine Atelier or are used under the appropriate rights.

The purchase of a product does not transfer copyright or image rights in the artwork unless expressly agreed otherwise in writing.

21. Governing law and language

All agreements, orders, and disputes relating to the Kleine Atelier online shop are governed by Dutch law, without prejudice to any mandatory consumer rights.

For orders placed within the Netherlands, the Dutch version of these Terms and Conditions shall prevail for interpretation.

For orders placed outside the Netherlands, the English version of these Terms and Conditions shall prevail for interpretation.
